What are the terms and conditions for?
- By purchasing on LTMEDIA, you enter into a contract with LTMEDIA. These General Terms and Conditions (GTC) define the contents of this contract.
Agreement with the terms and conditions
- By placing an order (e.g., clicking the button to complete your order), these GTC become binding for you. The GTC include the Claims Policy, Privacy Policy, Delivery Methods, and other documents.
Which parts of the GTC are binding and which are illustrative?
- At the beginning of selected chapters or more complex parts of the GTC, we have summarized the key information for you. These summaries are in italics (in infoboxes) and are for basic orientation only; they are not legally binding.
- However, numbered paragraphs are legally binding.
2. How to Shop on LTMEDIA
Purchasing via the e-shop
- Purchases can be made at www.683473.myshoptet.com
- The order is created at the moment you click the button to complete the order. Until then, you can freely modify your order in the cart, including the delivery and payment method.
- The contract is concluded only when we confirm your order. You will receive an order confirmation at your chosen email address, so please check the accuracy of your details. The confirmation email will also include these GTC and the Claim Policy.
- Subsequent order changes are possible only by mutual agreement or under the conditions set by law or these GTC.
- We strive to prevent e-shop outages, but rare failures may occur. Therefore, in case of a system failure or force majeure (e.g., a power outage), we are not liable for any downtime of the e-shop.
Ordering via email
- You can also place an order through an LTMEDIA representative, by phone, or by email, which you can find in the Terms and Conditions section.
- For email orders, the contract is concluded when the order confirmation is sent to your email. For phone orders, the contract is concluded upon your confirmation. If you place an order through an LTMEDIA representative, the contract is concluded upon (even partial) payment.
- LTMEDIA reserves ownership rights to the goods until you have fully paid the purchase price.
3. Deviations for Pre-Orders and Orders Over CZK 100,000 (EUR 3,962)
For:
- Pre-orders,
- Orders over CZK 100 000 (EUR 3,962)
the following deviations from these GTC apply, with the remaining provisions applicable as a supplement unless otherwise specified below.
- A pre-order is merely a reservation on a waiting list, not a contract for a future purchase. We cannot influence delivery times for pre-ordered goods. The purchase contract is concluded only when you are informed that your order is ready.
- If your order exceeds CZK 100,000 or EUR 3,962 (incl. VAT), you will be required to log into your user account, from which you have previously concluded a purchase contract with LTMEDIA that was not prematurely terminated (e.g., by withdrawal from the contract). If these conditions are not met, LTMEDIA may cancel your order and refuse to conclude the contract.
- To prevent and minimize potential damages, LTMEDIA may require full payment before shipping the selected goods. LTMEDIA is not obligated to deliver the goods until the purchase price is paid in full.
4. Delivery Options
- Delivery methods, conditions, and pricing can be arranged via email communication.
- Once a contract is concluded, LTMEDIA will deliver the selected goods using your chosen method, and you must allow delivery and accept the goods. Along with the goods, LTMEDIA will provide all relevant documentation. If you have chosen delivery to an address or a pickup point of one of our transport partners, LTMEDIA will hand over the goods to the carrier, who will ensure delivery in the specified timeframe. Until the goods are delivered to you or you refuse to accept them, the risk of damage remains with LTMEDIA.
- You will be informed about the expected delivery time and other details regarding the chosen delivery method via the email address you provided. The estimated delivery time may change depending on the logistical capabilities of LTMEDIA and/or its carriers, and you will be informed immediately. In case of force majeure or a system failure on LTMEDIA's part, LTMEDIA is not responsible for delayed delivery of goods.
- When receiving the goods, you should check whether the quantity of goods delivered matches your order. Additionally, you should inspect whether the package appears visibly damaged, crushed, or deformed. If the package is damaged, you have the right to refuse the goods, or alternatively, you may accept the goods and record their condition on the handover protocol together with the carrier. This protocol, along with a description of the shipment’s defect, should be sent by email to the contact address, or you may send it by fax or post to the address found in the Terms and Conditions section.
5. Claims - What to do in Case of Defective Goods
- All conditions and procedures for claims regarding goods are governed by the Claims Policy, which forms an integral part of these Terms and Conditions.
- If you sell, gift, or otherwise transfer ownership of purchased goods to another person, you and the new owner must inform us. If you fail to do so, we will treat you as the owner of the item (e.g., in the case of a claim, we will deal with you, and in the event of a refund, we will return the money to you).
6. Withdrawal from the Contract
- When withdrawing from a contract for a device that contains your personal data, we recommend that you back up your data and delete it from the device (if possible).
- Information regarding the method of refund when withdrawing from the contract can be found.
How can you withdraw from the contract?
- Withdrawal options are listed for you by processing speed and ease of submission:
- The recommended method to withdraw is via your customer account in the Claims and Returns section, or by email. Withdrawals made this way are processed the fastest due to direct integration with our systems.
- Lastly, withdrawal can also be made through a sales consultant via phone.
How and when must you return the goods?
- Once you withdraw from the contract, you must return the goods to us without undue delay, no later than 14 days after the withdrawal. You return the goods at your own cost, which will not be reimbursed. The goods should be undamaged, unused, and clean, including all accessories you received with it. If possible, the goods should be returned in the original packaging.
What if you return the goods damaged, scratched, or otherwise worn?
- If you return the goods damaged, scratched, or with other signs of wear, we may reduce the refund for the returned goods by an amount corresponding to the extent of the wear. For example, this would include returning a scratched panel, a dented monitor display, or a connector soiled with dirt. In such cases, the damage will be assessed, and the refund will be reduced accordingly.
How will we return your money?
- Money will be refunded to you within 14 days from the withdrawal from the contract using the same method as the payment. However, we are not obliged to return the money before the goods are returned or before you prove that you have sent the goods back. You also have the right to a refund of the costs incurred for the delivery of the goods when it was ordered, but only up to the amount equivalent to the least expensive delivery method offered on /
- In the case of cash payment, LTMedia may require you to present an identification document, such as an identity card or passport, in order to prevent damages and avoid money laundering. If you do not provide such a document, we may refuse to refund your money.
Withdrawal of LTMEDIA due to supplier’s reasons
- For goods marked as “in stock at the supplier," LTMEDIA has the right to withdraw from the contract if the supplier withdraws from the contract (usually due to unavailability of goods from the supplier’s side).
7. Complaints - How to Resolve Disputes with LTMEDIA
- We care about your satisfaction with LTMEDIA. And if something goes wrong, we will face the situation head-on. While the customer is our priority, unfortunately, we cannot rule out the possibility of a rare error by one of our employees, even with the best possible operation. To resolve your complaint as quickly as possible, we have an internal process in place for swiftly reviewing customer complaints.
Step one
By email.
Step two
If the complaint is not resolved to your satisfaction, these disputes can also be resolved out of court. In such cases, you can, as a consumer (provided it is not a purchase “on VAT”), contact an out-of-court dispute resolution entity, such as the Czech Trade Inspection Authority or resolve the dispute online through the ODR platform designated for this purpose. In matters related to reporting unlawful content according to Article 11 of the Terms and Conditions, you can contact any out-of-court dispute resolution entity that has been certified by the Czech Telecommunication Office as a coordinator for digital services.
8. Payments, Refunds, Invoice Details
- Until the full purchase price is paid, the goods remain the property of LTMEDIA (so-called retention of title).
- Unfortunately, the details on the invoice cannot be changed after the order is sent.
- For the refund of VAT to persons from third countries upon export of goods, in accordance with VAT law, the refund is made electronically to the customer’s account unless LTMEDIA decides otherwise. The preference for cashless payments is due to both legislation limiting cash payments and the restriction of money laundering risks.
Refund Upon Withdrawal from the Contract
- If you withdraw from the contract or if the money is refunded for another reason, we will return your money in the same manner as we received it from you. If, however, the money cannot be returned in the same way, for example, if you paid to a courier or your payment card has expired, you are responsible for the accuracy of the data provided for the refund. You are also responsible for the accuracy of the data if we agree to refund in another manner.
9. Prices
- All our prices are final, in Czech currency (CZK), and include VAT. The price of goods does not include delivery costs and, where applicable, cash on delivery, which will appear in the last stage of the “cart” depending on your selection. Prices are rounded to the nearest whole crown. It may happen that when ordering a larger number of items, the final price may differ slightly from the originally listed price due to rounding.
- If personal or company data, or a payment card, is misused during an order, we may declare the order invalid.
10. Security and Protection of Information
- Regarding the protection and processing of your data as a buyer by LTMEDIA, these Terms and Conditions for the Protection of Personal data apply.
- On the other hand, you, as a buyer, must protect your access details for your customer account (especially passwords) and not share them with anyone else. LTMEDIA is not responsible for the misuse of your login name or password by someone else. You must also not use the account, name, or password of any other customer.
11. Reporting Illegal Content
- Digital services are entering a new era in connection with new EU regulations related to the digital sector. LTMEDIA responds to these changes with a range of measures and procedures that meet and exceed the standards set by this regulation. The security of our platform is one of our highest priorities. Therefore, we have implemented a mechanism for reporting unlawful content uploaded by third parties, such as reviews by our customers. The unified contact point tool allows users to participate in the protection and security of our online store easily and actively, and at the same time streamlines communication between us, our customers, contractual partners, and supervisory authorities. All your inquiries, concerns, and feedback will be addressed quickly and efficiently.
- We have implemented high standards of transparency and information on moderation. For example, in the case of user reviews, we explain everything in detail on this page, including the process of review inspection and approval. We will be happy to explain how content moderation works.
- We have also committed to regularly publishing reports on content moderation. These reports, published annually, provide information on the number of unlawful content reports made through the mechanism under Article 11 of the Terms and Conditions, measures taken based on them, and also provide a transparent view of how we handle user account suspensions and other aspects of content moderation. We also publish the number of our active users every six months.
12. Final Provisions
- Relations and potential disputes arising from the contract will be governed exclusively by the laws of the Czech Republic and will be resolved by the competent courts of the Czech Republic. The UN Convention on Contracts for the International Sale of Goods (CISG) will not apply in accordance with Article 6 of this convention.
- The contract is concluded in the Czech language. If a translation of the contract text is required for the buyer’s needs, in case of a dispute regarding the interpretation of terms, the interpretation of the contract in the Czech language shall prevail.
- The concluded contract is archived by LTMEDIA in the internal system for at least three years from its conclusion, but no longer than the period required by the applicable legal regulations, for the purpose of its successful completion, and is not accessible to third parties. LTMEDIA will provide the customer access to the contract in justified cases. Information about the individual technical steps leading to the conclusion of the contract is available in these Terms and Conditions, where this process is clearly described.
- If some chapters provide a brief summary for basic orientation followed by more detailed text, in case of discrepancies, the more detailed text, which usually begins with a title like “more information,” “detailed conditions,” etc., will take precedence.
- The terms of marketing campaigns are governed by their specific conditions of the particular action. Ongoing campaigns can be found on the homepage at www.683473.myshoptet.com. If such specific conditions do not exist, the campaign will follow the general conditions listed in the Claims section.
